Terms of Service

These Terms of Service apply to the supply of tools, hardware and related products and services by Gondal Tools Pty Ltd (ABN 82 702 522 843) of Perth, Western Australia, and to your use of our website at https://gondaltools.site. By placing an order, requesting a quote or using our website, you agree to these terms.

1. Who we are

Gondal Tools Pty Ltd (ABN 82 702 522 843) supplies hand tools, power tools, fasteners, safety equipment and general hardware to trade and retail customers across Perth, Western Australia. All enquiries should be directed to ceo@gondaltools.site.

2. Quotes and orders

• Quotes provided by us are valid for 14 days from the date of issue unless otherwise stated in writing.
• An order is accepted only once we confirm it by email. We may decline or cancel any order, in whole or in part, for any reason including stock unavailability or pricing errors.
• It is your responsibility to ensure that products ordered are suitable for your intended application and comply with any relevant standards, site requirements or specifications.

3. Pricing and payment

• All prices are quoted in Australian dollars (AUD) and include goods and services tax (GST) where applicable, unless expressly stated otherwise.
• Prices may change without notice. The price applicable to your order is the price confirmed at the time we accept your order.
• Unless a trade account has been established, payment is required in full before goods are dispatched or released for collection.
• Overdue amounts may attract interest and reasonable recovery costs, to the extent permitted by law.

4. Delivery and collection

• Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by suppliers, carriers or events beyond our reasonable control.
• Risk in goods passes to you on delivery or collection. Title in goods remains with us until payment is received in full.
• Delivery charges are quoted separately where applicable. Delivery is available within the Perth metropolitan area and by arrangement to other parts of Western Australia.

5. Products, availability and substitutions

• Product images and descriptions on our website are indicative only and may differ slightly from the actual product, including packaging and colour.
• Where a product is unavailable, we may offer an equivalent substitute of equal or better quality and comparable price. You may decline a substitute and receive a refund of the affected portion of your order.

6. Consumer guarantees — your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth), or any other law that cannot lawfully be excluded.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Where you acquire goods for business purposes and the transaction is not of a kind to which consumer guarantees apply under the Australian Consumer Law, our liability is limited to the extent permitted by law.

7. Manufacturer warranties

Many products we supply, including power tools, carry a separate manufacturer's warranty. Manufacturer warranty terms are in addition to, and do not limit, your rights under the Australian Consumer Law. Warranty claims may be lodged through us or directly with the manufacturer.

8. Returns and refunds

• If goods are faulty, not as described or do not match the sample shown, you are entitled to a remedy under the Australian Consumer Law. Please contact us at ceo@gondaltools.site with your order details.
• Change-of-mind returns are accepted at our discretion, provided goods are unused, in original packaging and returned within 14 days of purchase. Restocking fees may apply.
• Some products, including personalised or special-order items and items that have been used or installed, may not be eligible for change-of-mind return.

9. Safe use of products

You acknowledge that tools and hardware can be hazardous if misused. You must follow all manufacturer instructions, safety warnings and applicable workplace health and safety requirements when using products supplied by us. We are not responsible for injury, damage or loss arising from incorrect use, modification, inadequate maintenance or unsuitable application of products.

10. Trade accounts

• Trade accounts may be approved at our discretion and are subject to our credit application process, including satisfactory references and identity verification.
• Trade account holders must pay invoices by the due date stated on the invoice. We may vary or withdraw credit facilities at any time on written notice.

11. Website use and intellectual property

• The content of this website, including text, layout and branding, is owned by or licensed to Gondal Tools Pty Ltd and may not be copied or republished without our written permission.
• Website content is provided for general information only and does not constitute professional, technical or trade advice. Always confirm suitability of a product for your specific task before purchase.
• We do not guarantee that the website will be uninterrupted, error-free or free of harmful code.

12. Limitation of liability

To the fullest extent permitted by law, and except where the Australian Consumer Law applies, we are not liable for indirect, incidental or consequential loss, including loss of profit or business interruption, arising from the supply of goods or use of this website. Where liability cannot be excluded, our liability is limited, at our option, to the resupply of the goods or payment of the cost of resupply, or the repair or replacement of the goods, as permitted by the Australian Consumer Law.

13. Privacy

We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

14. Governing law

These terms are governed by the laws of Western Australia, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Western Australia.
